Terms of Service

THE CONTRACT BETWEEN YOU AND CREDIT365

By creating a Credit365 account, you agree to these Terms. Please also review our Disclosures and Privacy Policy, which are incorporated into these Terms by reference.

1. Who We Are

Credit365 ("we", "us", "our", "the Service") is a self-service software platform operated by Rhythm Capital, accessible at credit365.io. These Terms of Service govern your use of the Service.

2. Eligibility

To use Credit365 you must:

  • Be at least 18 years of age
  • Be a legal resident of the United States
  • Have the legal capacity to enter into a binding contract
  • Not be currently barred from using the Service by us for any prior violation
  • Provide accurate, current, and complete information when creating your account

3. The Service — What Credit365 Does

Credit365 is a self-service technology platform. You, the client, use our tools to:

  • Upload your own credit report(s)
  • Receive an AI-generated analysis of negative items
  • Generate AI-drafted dispute letters
  • Review, edit, and approve each letter before mailing
  • Have approved letters mailed via USPS Certified Mail + Electronic Return Receipt through our mailing partner (LetterStream)
  • Track the status of each mailed dispute

You are the party disputing items on your credit report. Credit365 does not act as your legal representative, agent, or attorney-in-fact. Each letter is sent in your name with your explicit authorization (by clicking Mail), and the credit bureaus receive your dispute directly.

4. What Credit365 Is NOT

  • We are not a law firm. Using Credit365 does not create an attorney-client relationship. Nothing we provide is legal advice.
  • We are not a credit counselor or financial advisor.
  • We are not acting as your agent. You are the consumer authoring and submitting each dispute.
  • We do not guarantee any specific outcome on any dispute. See our Disclosures.
  • We cannot remove accurate information from your credit report.

5. Your Responsibilities

When you use Credit365, you agree to:

  • Provide accurate personal information (name, address, email) — mailing letters with a wrong return address may cause the bureau to reject or misroute the dispute
  • Only upload credit reports that belong to you or that you have legal authorization to dispute
  • Review and edit each generated letter before clicking the Mail button — you are responsible for the final content of each letter
  • Only dispute items that you have a good-faith basis to dispute (inaccurate, incomplete, obsolete, unverifiable, or fraudulent)
  • Not submit knowingly false or misleading information in any dispute
  • Keep your login credentials secure and not share your account with others
  • Pay any fees that come due in a timely manner
  • Not misuse, reverse-engineer, scrape, or attempt to exploit the platform

6. Fees and Payment

Pricing

  • $69.00 — 3-bureau dispute (one certified letter to each of TransUnion, Equifax, and Experian)
  • $25.00 — Single-bureau dispute (one certified letter to one bureau of your choice)

Each fee is charged per dispute item, per submission round. Re-disputing the same item (rounds 2, 3, etc.) requires a new payment. All prices are in U.S. dollars.

Payment Processor

Payments are processed by PayPal. You may use a PayPal account balance, a linked bank account, or any credit/debit card PayPal accepts. Credit365 does not see, store, or touch your card number, CVV, or PayPal credentials — those are handled entirely within PayPal's secure environment.

Refund Policy

ALL SALES FINAL ONCE THE LETTER IS GENERATED. Fees are non-refundable after the AI has generated your dispute letter(s). This is because:

  • Letter generation incurs real AI processing costs at the moment you click the dispute button
  • Certified mail postage is non-recoverable — USPS does not refund certified mail fees, nor does LetterStream refund once a letter enters the USPS system
  • Your review opportunity is before the Mail button. You can preview and edit every letter. You only commit once you click Mail with the confirmation dialog.

Refunds will only be considered in the following limited circumstances:

  • Duplicate charge for the same dispute (technical error) — full refund
  • Platform failure preventing letter generation after payment — full refund
  • Fraudulent charge (not authorized by account owner) — handled through PayPal dispute process

To request a refund in one of the above situations, email support@credit365.io with the payment ID and details. We respond within 2 business days.

Chargebacks

If you initiate a chargeback with PayPal for any reason other than the limited circumstances above, we may: (a) dispute the chargeback with evidence of the generated letter, the Mail button confirmation, and USPS tracking records; (b) suspend your account; (c) recover costs and fees through available legal channels. Please contact us first before filing a chargeback — we'd rather fix a problem than fight over it.

7. Account Suspension and Termination

We may suspend or terminate your account, with or without prior notice, if we determine in good faith that you have:

  • Violated these Terms or our Disclosures
  • Submitted false, fraudulent, or knowingly misleading information
  • Disputed accurate information in bad faith or in a pattern that suggests attempted fraud on credit bureaus
  • Used the platform to dispute credit reports that do not belong to you
  • Initiated a chargeback without first contacting support
  • Engaged in abusive, threatening, or harassing communication with staff
  • Attempted to compromise or misuse the platform

You may terminate your account at any time by emailing us. Upon termination, your data will be retained for the periods specified in our Privacy Policy and then deleted.

8. Intellectual Property

All software, design, text, graphics, logos, and content on Credit365 (other than user-uploaded content and user-generated letters) are the property of Rhythm Capital or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

You retain ownership of the credit reports you upload and the dispute letters generated for you. By using the Service, you grant Credit365 a limited license to process, store, modify, and transmit that content as necessary to provide the Service.

The "Credit365" name and logo are trademarks. You may not use them without written permission.

9. Disclaimers — Please Read

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, Credit365 disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Warranties arising from course of dealing or usage of trade
  • Warranties of non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding any specific outcome, result, or credit score improvement
  • Warranties regarding the accuracy of AI-generated content

You use the Service at your own risk. You are responsible for reviewing every letter before mailing, for the accuracy of information you provide, and for the decisions you make based on AI output.

10. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Credit365, Rhythm Capital, or their officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of credit score, loss of creditworthiness, loss of reputation, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise.

Our aggregate liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the total amount you paid to Credit365 in the 12 months preceding the claim, or (b) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Credit365, Rhythm Capital, and their officers, employees, and agents from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of:

  • Your violation of these Terms
  • Your violation of any third-party right (including copyright, privacy, or intellectual property)
  • Your submission of false or misleading information in any dispute
  • Disputes you submit regarding credit reports that do not belong to you
  • Any claim by a credit bureau, furnisher, or other third party arising from letters you authorized Credit365 to mail

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action or proceeding arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

(If you have an attorney, you may want to add an arbitration clause, class-action waiver, and specific venue language here. Those clauses are enforceable in most states but require state-specific drafting.)

13. Changes to These Terms

We may update these Terms from time to time. The current version always appears at credit365.io/terms.html. If we make material changes, we'll notify active users by email and require re-acceptance before you can continue using the Service. Continued use of the Service after a Terms update constitutes acceptance of the updated Terms.

14. Entire Agreement and Severability

These Terms, together with our Disclosures and Privacy Policy, constitute the entire agreement between you and Credit365 regarding the Service. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
